Spouses & Unmarried Children Under 21 of LPRs (lawful permanent residents) can apply for Green Cards in August 2013, when all priority dates will be CURRENT.

As was announced by the US Department of State in their monthly Visa Bulletin, Spouses and Children of LPRs (permanent residents) can apply for green cards in August. Visa numbers will be made available in August 2013 to spouses and unmarried children under 21 of  permanent residents for ALL countries of birth.

The priority dates will be CURRENT in August 2013 for all countries of birth in this visa category. Therefore, they will advance by almost 2 years in just one month!

Please remember that this will be true only in August, not in July. It's also not clear what priority dates will be announced in September 2013.

As a practical matter, if you are a LPR (permanent resident) and you petitioned for your spouse and children who are abroad, they can apply for immigrant visas (green cards) in August. If your spouse and children and lawfully in the United States and are not overstays, they can apply for adjustment of status (green card). If you have any doubts or your spouse is overstay, you shall consult with an experienced immigration attorney before filing any immigration petition or application.

С практической точки зрения, если вы женаты (замужем), ваш супруг сможет получить иммиграционную визу в посольстве или сможет подать петицию и заявление на грин карту, если находятся в США легально и не являются overstay. Если у вас есть какие-то сомнения, или ваш супруг долгие годы проживает в США нелегально, вам следует проконсультироваться у иммиграционного адвоката, чтобы избежать проблем.

USCIS Approved First I-130 Petition for a Same-Sex Married Couple Last Friday.

USCIS approves first I-130 petition involving a same-sex couple, in the wake of last week's Supreme Court ruling striking down the Defense of Marriage Act.

An American man in Florida and his husband, who is from Bulgaria, have become the first same-sex married couple to be approved for a permanent resident visa.

Immigration officials said the visa agency, United States Immigration and Citizenship Services, would announce new procedures early this week for same-sex binational couples seeking green cards. The first approval was also supposed to be issued this week, officials acknowledged, but eager officers at the agency pressed the button on the notice on Friday.

For the last two years, the agency has kept a list of same-sex couples whose green card petitions were denied, the officials said, anticipating that the Supreme Court would eventually weigh in on DOMA. Those denials will now be reversed without couples having to present new applications, if no other issues have arisen. Gay couples with no denials will move through the system at the same pace as traditional spouses, officials said.
